These are the Terms and Conditions of John Preston Flowers online bouquet service.

YOUR ORDER

Our website will guide you through the order process and you will be required to provide us with your personal details, the recipient's details, delivery details, postcodes and telephone numbers and all necessary payment details. Your order will only be processed if all required information is provided.

DELIVERY

John Preston Flowers delivers within a 20 mile radius of Ashbourne Town Centre. Delivery costs are based on the postcode of the recipient.

We can also offer nationwide NEXT DAY DELIVERY in mainland UK

Our delivery service is not available on Sundays and Public Holidays. We reserve the right not to accept orders for delivery over the Christmas period, and at other times as posted on our website, when applicable. Deliveries will be made between 9am and 6pm, unless otherwise arranged and agreed.

Please ensure that correct address and contact details are entered when placing your order. Incorrect information may lead to problems or delays in delivery. Should we encounter any difficulties when delivering we will contact you on the telephone number or at the email address given to notify you. John Preston Flowers will not be held responsible for any order which is not delivered due to incorrect or incomplete information being provided by you at the time of placing the order.

Should there be no one at the delivery address when our driver arrives, a card will be left for the recipient to contact us to arrange redelivery. We will attempt one additional delivery at no extra cost. Should the second delivery fail we will contact you to arrange further delivery, at which time an additional delivery cost would be incurred.

If the bouquet can be left with a neighbour, or alternative instructions have been given by you when placing the order, a card will be left informing the recipient of this.

Flowers that are sent to hotels, hospitals, military bases and offices will be left at a main reception. The signature of the person who receives the order shall be accepted as proof of delivery and fulfilment of the order. For hospital deliveries please ensure that the full name and ward name or number are included.

The delicate nature of the product that we provide means that all products are subject to availability. All flowers are hand picked by our team of creative florists and we reserve the right to substitute a product of equivalent value and quality without notice, should this be necessary.

PERSONAL MESSAGES

You agree that any messages that you instruct us to include with your bouquet will not contain anything that can be construed as vulgar, abusive, harassing, racist or defamatory or that may cause upset or embarrassment to the recipient or any other person. John Preston Flowers reserves the right to refuse to send or display objectionable messages.

PAYMENT AND SECURITY

John Preston Flowers accepts the following methods of payment: MasterCard, Maestro, Visa, Delta, Visa Electron, Solo

All payments are made through a secure payment gateway and no credit card details are kept or recorded.

CANCELLATION

If you need to cancel or amend your order please notify us as soon as possible by telephone on 01335 3000 76 no later than 1 working day before the delivery date. We can then process the cancellation, refund or amendment of your order.

RETURNS POLICY

We hope that you will be delighted with the flowers that you receive from John Preston Flowers. Should you not be entirely satisfied or if you believe that we have sent you an incorrect order, please contact us on  01335 3000 76 as soon as possible. We regret that due to the delicate nature of the product all flowers are non-refundable.

LIABILITY

Should you not be entirely satisfied with the flowers that we deliver, or if you believe that they are damaged or defective we shall have no liability to you unless you notify us within 48 hours of the delivery of the products in question.

Save as precluded by law, we will not be liable to you for any indirect or consequential loss, damage or expenses (including loss of profits, business or goodwill) howsoever arising out of any problem you notify to us under this condition, and we shall have no liability to pay any money to you by way of compensation.

We shall have no liability to you for any failure to deliver products you have ordered or any delay in doing so that is caused by any event or circumstance beyond our reasonable control, including breakdown of systems or network access, flood, fire, explosion or accident.

Except for our affiliates, directors, employees or representatives, a person who is not a party to this agreement has no right under the UK Contracts (Rights of Third Parties) Act 1999 to enforce any term of this agreement, but this does not affect any right or remedy of a third party that exists or is available apart from that Act.

DISCLAMER

Whilst we agree to use our reasonable endeavours to ensure that the website is fully operational and error free, we cannot guarantee this and therefore accept no responsibility for any defects and/or interruption of the website, and shall be released from our obligations under these Terms & Conditions in the event of any cause beyond our reasonable control which renders the provision of the website impossible or impractical.

We exclude, to the fullest extent permitted by applicable laws, and save in respect of death or personal injury arising from our negligence, all liability of any claims, losses, demands and damages arising directly or indirectly out of or in any way connected with your use or inability to access the John Preston Flowers Ltd site and/or the John Preston Flowers Ltd service. This exclusion shall apply in respect of, without limitation, any costs, loss of profits, loss of contracts or business opportunity, loss of data and any other consequential, incidental, special or punitive damages, even if we have been advised of the possibility of such damages, whether arising in contract, tort, under statute or otherwise provided that nothing contained in these Terms & Conditions affects or will affect the statutory rights of the customer or the recipient in relation to the quality, fitness or description of the products supplied.
